By accessing or using API Polygraph's website and services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

Services Description

API Polygraph provides the following services:

  • Professional polygraph examinations conducted by certified examiners
  • Clarity Check digital assessment service for relationship clarity
  • Consultation services related to truth verification
  • Educational resources and guides

Voluntary Participation

All polygraph examinations and assessments are voluntary. No individual shall be coerced or forced to participate in any testing. Participation requires informed consent from all parties involved.

Accuracy and Limitations

Polygraph Examinations

While polygraph examinations conducted by certified examiners have a high degree of accuracy, no testing method is 100% accurate. Results should be considered as one piece of information within a broader context.

Clarity Check Assessment

The Clarity Check service is a behavioral assessment tool designed to provide insights and guidance. It is not a formal polygraph examination and should not be relied upon as the sole basis for major life decisions. Results are for informational and educational purposes only.

Legal Admissibility

The admissibility of polygraph examination results varies by jurisdiction and case type. While our examiners are court-qualified experts, we cannot guarantee that results will be admissible in your specific legal matter. Consult with your attorney regarding admissibility in your jurisdiction.

Payment Terms

  • Payment for services must be received before or at the time of service
  • Deposits for polygraph examinations are non-refundable once an appointment is scheduled
  • Pricing may vary based on service type, location, and specific requirements
  • Payment is processed through secure third-party payment processors
  • We reserve the right to change our pricing at any time, though changes will not affect services already purchased

Cancellation and Rescheduling

Polygraph Examinations:

  • Cancellations must be made at least 48 hours before the scheduled appointment
  • Cancellations made less than 48 hours before the appointment may result in forfeiture of deposit
  • Rescheduling is subject to examiner availability
  • No-shows will result in forfeiture of all fees paid

Clarity Check Assessment:

  • Digital assessments are non-refundable once access has been provided
  • Links remain valid for a specified period as indicated at time of purchase

Confidentiality

All examination results and assessment data are confidential and will not be disclosed to any third party without the client's written consent, except as required by law or court order. Clients are responsible for how they choose to share their own results.

Prohibited Uses

You may not use our services:

  • To harass, intimidate, or coerce any individual
  • In violation of any applicable laws or regulations
  • To impersonate or misrepresent your affiliation with any person or entity
  • To violate the privacy rights of others
  • For any unlawful or fraudulent purpose

Limitation of Liability

To the fullest extent permitted by law, API Polygraph shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. Our total liability shall not exceed the amount paid by you for the specific service in question.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

Indemnification

You agree to indemnify and hold harmless API Polygraph and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these Terms.

Professional Standards

All polygraph examinations are conducted in accordance with professional standards established by the American Polygraph Association (APA) and applicable state regulations. Our examiners maintain current certifications and adhere to ethical guidelines.

Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of API Polygraph or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the states in which we operate, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration in accordance with applicable arbitration rules.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
